Terms of Service

By downloading, installing, accessing, or using the SoberX mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and ICI Tech Teknoloji A.Ş. ("Company", "we", "us", or "our"), a company registered in Turkey.

If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

To use the Service, you must:

• Be at least 18 years of age
• Be capable of forming a legally binding contract under applicable law
• Not be prohibited from using the Service under the laws of your country of residence or any other applicable jurisdiction

Age verification: We do not independently verify age at sign-up. By creating an account or using the Service, you represent and warrant that you meet the eligibility requirements above. If we learn that a user is under 18, we will terminate their account and delete their data promptly.

The Service is intended for personal, individual use only. Each account is for a single user. Sharing your account credentials with others is not permitted.

Optional registration

You may use many features of SoberX without creating an account. In offline mode, all data is stored locally on your device and no account credentials are required.

Creating an account

If you choose to create an account, you agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information up to date
• Maintain the confidentiality of your password and not share it with any third party
• Notify us immediately at app@icitech.com.tr if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to refuse registration, suspend, or terminate any account at our discretion, including where we believe the information provided is inaccurate, false, or in violation of these Terms.

One account per person

Each person may maintain only one account. Creating multiple accounts to circumvent a suspension, access free trial benefits more than once, or for any other reason is prohibited.

We may offer a free trial of SoberX Premium for a limited time period ("Trial Period"). The following terms apply:

• The Trial Period length will be clearly stated at the time of sign-up.
• You may be required to provide payment method details via the App Store (iOS) or Google Play (Android) to start a free trial.
• Automatic conversion: At the end of the Trial Period, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends.
• Cancellation before trial ends: To avoid being charged, you must cancel before the last day of the Trial Period through the platform where you activated the trial (App Store or Google Play). Cancelling the app or deleting it from your device does not cancel the trial or subscription.
• One free trial per person, per Apple ID or Google account. We reserve the right to determine free trial eligibility and to end or modify the free trial offer at any time.
• Free trial access is provided to allow you to evaluate the Service. Any abuse of the free trial (e.g., creating multiple accounts to extend trial access) may result in account termination.

Auto-renewing subscription

SoberX Premium is offered as an auto-renewing subscription available through:

• Apple App Store (iOS devices)
• Google Play (Android devices)

All billing is managed by Apple or Google on their respective platforms. We do not process payment transactions directly and do not store your payment card details.

Subscription terms

• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select).
• Your subscription automatically renews at the end of each billing period unless you cancel it before the renewal date.
• The renewal charge will be applied to your App Store or Google Play account within 24 hours before the end of the current period.
• Prices are displayed in your local currency at the time of purchase and may vary by region. Applicable taxes may be added by Apple or Google.
• We reserve the right to change subscription pricing. Price changes will be notified in advance and will take effect at your next renewal. Continuing to use SoberX Premium after a price change constitutes acceptance of the new price.

Subscription management via RevenueCat

We use RevenueCat to manage subscription state (active, expired, in trial, cancelled). RevenueCat receives a pseudonymous customer ID and your subscription status only — not your name, email, payment details, or any recovery data. See our Privacy Policy for details.

Free Plan

Core SoberX features remain available at no charge on the Free Plan. We reserve the right to adjust which features are included in the Free Plan at any time, with reasonable notice.

How to cancel

You must cancel your subscription through the platform where you purchased it:

Android	Google Play → Profile → Payments & subscriptions → Subscriptions → SoberX → Cancel

Cancelling within the app, uninstalling the app, or contacting us directly does not cancel your subscription.

Effect of cancellation

• Cancellation takes effect at the end of the current paid billing period.
• You retain access to Premium features until the end of the period you have already paid for.
• After cancellation, your account reverts to the Free Plan. Your data is not deleted.

Refunds

All purchases are made through Apple (App Store) or Google (Google Play), and refund requests are subject to their respective refund policies:

We do not issue refunds directly. If you believe a charge was made in error, please contact the platform through which you purchased first.

What SoberX is

SoberX is a private, self-help habit-change and recovery-support companion. It is designed to help you:

• Track habits and monitor your progress
• Build daily rituals and commit to personal goals
• Navigate urges with short, structured in-app tools (Urge Wave, Focus Tunnel)
• Understand patterns in your own logs through Risk Radar
• Save and reflect with Voice Release
• Reach trusted contacts through Safety Chain
• Visualize the savings and time you have reclaimed

What SoberX is not

SoberX is not any of the following:

• A medical device or clinical diagnostic tool
• A telehealth or therapy platform
• A substitute for professional medical treatment, rehabilitation, or mental health care
• A crisis intervention or emergency service
• A guarantee of any health, behavioural, or recovery outcome

The content, tools, prompts, and pattern summaries within SoberX are general informational and motivational aids. They are not personalized medical advice and should not be treated as such. Individual results will vary.

Please read this section carefully.

Not a medical service

SoberX does not provide medical advice, diagnosis, or treatment. Nothing in the Service — including Urge Wave guidance, Risk Radar summaries, Voice Release reflections, motivational content, or milestone messaging — constitutes or replaces professional medical, psychiatric, psychological, or clinical advice.

Always seek the advice of a qualified health professional regarding any medical condition, mental health concern, or recovery plan. Never disregard professional medical advice or delay seeking it because of something you read or experienced in SoberX.

Crisis situations

SoberX is not an emergency service. If you or someone else is in immediate danger, experiencing a medical emergency, or having thoughts of self-harm or suicide:

• Call your local emergency number (e.g., 112 in Turkey)
• Contact a crisis helpline in your country
• Go to your nearest emergency room

SoberX's Safety Chain feature is a personal contact tool — it is not a monitored emergency response system and does not connect you to professional crisis services.

Withdrawal and detox

For some substances (including alcohol and certain medications), sudden cessation can cause serious or life-threatening withdrawal symptoms. Do not attempt to stop using any substance abruptly without first consulting a qualified medical professional. SoberX does not provide medical guidance on withdrawal or detox.

Limitation of liability for health outcomes

To the maximum extent permitted by applicable law, we are not liable for any health outcomes, relapse, injury, or other consequence arising from your use of or reliance on the Service. See Section 18.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree to:

• Use the Service solely for personal, non-commercial habit-change and recovery support
• Keep your account credentials secure and confidential
• Provide accurate information when requested
• Comply with all applicable laws and regulations
• Respect the intellectual property rights of the Company

You agree not to:

• Misrepresent age or identity: Create an account if you are under 18, or impersonate another person
• Circumvent access controls: Use technical means to access features you have not paid for, bypass subscription requirements, or exploit the free trial more than once
• Reverse engineer: Decompile, disassemble, reverse engineer, or attempt to derive the source code of the Service or any part of it
• Scrape or mine data: Use automated tools, bots, scrapers, or crawlers to extract data from the Service
• Interfere with the Service: Introduce malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to the Service or its infrastructure
• Resell or sublicense: Sell, resell, license, sublicense, rent, or otherwise commercially exploit the Service or your access to it
• Violate applicable law: Use the Service in any way that violates Turkish law, EU law where applicable, or any other applicable legal requirement

Violation of this section may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

Our rights

The Service and all Company Content — including but not limited to the SoberX name and logo, app design and interface, feature concepts (Urge Wave, Risk Radar, Focus Tunnel, Voice Release, Safety Chain, Daily Pledge), software code, text, graphics, animations, and sounds — are owned by or licensed to ICI Tech Teknoloji A.Ş. and are protected by Turkish and international intellectual property law.

Nothing in these Terms transfers any intellectual property rights to you. You receive only a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

Feedback

If you submit feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, incorporate, and exploit that Feedback in any way, without obligation or compensation to you.

Ownership

You retain ownership of the content you create within SoberX — including habit logs, journal entries, goals, motivation text, and Voice Release recordings ("Your Content").

Licence you grant us

By using the Service, you grant us a limited, non-exclusive, worldwide licence to store, process, and display Your Content solely to the extent necessary to provide the Service to you. We do not use Your Content for advertising, model training, or any purpose beyond operating the Service.

Local-only data

Data stored only on your device (Voice Release audio, Safety Chain contacts, Urge Wave logs) is not transmitted to us and is therefore not subject to the licence above.

Responsibility for your data

You are solely responsible for Your Content and for ensuring it complies with applicable law. We are not responsible for any loss of Your Content resulting from device failure, app deletion, or other circumstances outside our control.

Data portability and deletion

You may request an export of your account data or delete your account at any time through Settings or by contacting app@icitech.com.tr. See our Privacy Policy for details on how we handle data deletion.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

Key commitments:

• We do not sell your personal data.
• We do not share your recovery data (addiction category, sobriety status, urge logs, journal content) with advertising platforms.
• Sensitive in-app data (Voice Release, Safety Chain, crisis tool logs) is stored only on your device.

App Store and Google Play

The Service is distributed through the Apple App Store and Google Play. Your use of those platforms is governed by their respective terms of service. We are solely responsible for the Service and its content — Apple and Google have no obligation to maintain or support the Service.

Apple — Additional terms (iOS users)

In accordance with Apple's standard requirements:

• These Terms are between you and ICI Tech Teknoloji A.Ş. only — not Apple.
• Apple has no obligation to provide maintenance or support services for SoberX.
• In the event of any failure of SoberX to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to SoberX.
• Apple is not responsible for any claims relating to SoberX, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

RevenueCat

We use RevenueCat to manage subscription state. RevenueCat's use of your data is governed by its own Privacy Policy and Terms.

Third-party links

The Service may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or services of any third party. Your use of third-party services is at your own risk and subject to those third parties' terms and privacy policies.

Availability

We aim to provide the Service on a continuous basis but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or events beyond our control (e.g., force majeure).

Offline functionality

Core SoberX features are designed to work offline. Certain features (such as cloud backup and subscription verification) require an internet connection.

Updates

We may release updates to the app from time to time. Updates may change or remove features. We recommend keeping the app updated to the latest version.

Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will give reasonable advance notice of material changes where feasible. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, either express or implied.

We specifically disclaim all implied warranties, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of any content within the Service
• That the Service will be uninterrupted, error-free, or free of harmful components
• That the Service will meet your requirements or expectations
• Any health, behavioural, or recovery outcome resulting from use of the Service

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.

To the maximum extent permitted by applicable Turkish law, ICI Tech Teknoloji A.Ş., its directors, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, goodwill, or business
• Personal injury, death, or health outcomes arising from use of or reliance on the Service
• Any damages exceeding the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) ₺500 (five hundred Turkish lira)

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

EU consumer carve‑out: If you are an EU consumer (habitually resident in an EU Member State), nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by mandatory consumer protection laws applicable to you.

Nothing in these Terms limits our liability for:

• Death or personal injury caused by our gross negligence or wilful misconduct
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited under mandatory Turkish law

You agree to indemnify, defend, and hold harmless ICI Tech Teknoloji A.Ş. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service in violation of these Terms
• Your violation of any applicable law or third-party right
• Any content or information you submit through the Service
• Your misrepresentation of your age, eligibility, or identity

Termination by you

You may stop using the Service at any time. To delete your account, go to Settings → Account → Delete Account or contact us at app@icitech.com.tr. Account deletion does not automatically cancel an active subscription — you must cancel separately through the App Store or Google Play (see Section 7).

Termination by us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if:

• You breach any provision of these Terms
• We are required to do so by law or a regulatory authority
• We reasonably believe your use of the Service poses a risk to other users, the Service, or third parties
• We decide to discontinue the Service

Effect of termination

Upon termination:

• Your licence to use the Service ends immediately
• We may delete your account data in accordance with our Privacy Policy retention schedules
• Provisions of these Terms that by their nature should survive termination will survive, including Sections 9, 12, 17, 18, 19, and 21

Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, including the Turkish Code of Obligations, the Law on Consumer Protection No. 6502, and the Electronic Commerce Law No. 6563, without regard to conflict of law principles.

EU consumer carve‑out: If you are an EU consumer (habitually resident in an EU Member State), this choice of Turkish law does not deprive you of mandatory consumer protection rights under the laws of your country of residence.

Informal resolution

We encourage you to contact us first at app@icitech.com.tr before initiating any formal proceedings. Most concerns can be resolved quickly and informally.

Formal disputes

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts and enforcement offices of Istanbul (Çağlayan), Turkey.

EU consumer carve‑out: Where applicable mandatory EU consumer law provides that you may bring proceedings in your country of residence (and/or that we must bring proceedings in your country of residence), nothing in this section limits those rights.

Consumer rights

If you are a consumer under Turkish law, you retain the rights afforded to you under the Law on Consumer Protection No. 6502 and applicable consumer regulations, including the right to apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) for disputes within the statutory threshold.

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices.

When we make changes:

• We update the "Last updated" date at the top of this document
• For material changes (changes to pricing, liability, dispute resolution, or your rights), we will notify you via in-app notice or email at least 14 days before the changes take effect
• For minor changes (clarifications, formatting, non-substantive updates), we will post the updated Terms without prior notice

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account before the changes take effect.

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ICI Tech Teknoloji A.Ş. regarding the Service and supersede all prior agreements, representations, and understandings.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver is only effective if made in writing and signed by an authorized representative of ICI Tech Teknoloji A.Ş.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, war, government action, power failures, internet outages, or acts of third parties.

Language

These Terms are written in English. In the event of any inconsistency between an English version and a translated version, the English version prevails.
